Definitions

In this agreement, the following terms have the meanings set out below:

• "Service" — the online courses, learning materials, mentor sessions, and related resources made available by Witaya Lab through witayala.live.
• "User" / "You" — any individual who accesses, enrols in, or uses the Service.
• "We" / "Us" / "Our" — Witaya Lab, located at 67 Nimmanhaemin Road, Suthep, Chiang Mai 50200, Thailand.
• "Content" — all course materials, videos, exercises, code samples, written guidance, and other learning resources provided through the Service.
• "Agreement" — these Terms & Conditions, together with our Privacy Policy and Cookie Policy, which together form the complete agreement between you and us.
• "Enrolment" — the act of registering for a course and completing the applicable payment.

Acceptance of Terms

By accessing our website or enrolling in any course, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our Service.

• You must be at least 18 years old, or have the consent of a parent or guardian, to enrol.
• You confirm that you have the legal capacity to enter into this agreement.
• If you are accessing the Service on behalf of an organisation, you confirm you have authority to bind that organisation.

Service Description

Witaya Lab offers online courses focused on AI development, currently including:

• Python for AI Beginners — an introductory course covering Python essentials for data and AI work (approx. 6 weeks, part-time).
• Natural Language Processing — a practical course in language-focused machine learning (approx. 9 weeks, part-time).
• Applied AI Project Track — a mentor-guided track for building a complete AI project (approx. 3 months, part-time).

We reserve the right to update course content, adjust schedules, or modify availability with reasonable notice. Access to the Service is provided via the internet and requires a suitable device and connection.

User Accounts

Where an account is required to access course materials:

• You are responsible for keeping your login credentials secure and confidential.
• You must notify us promptly if you suspect unauthorised access to your account.
• You may not share your account or credentials with others.
• We may suspend or close accounts found to be shared or misused, without refund.

User Responsibilities

We ask that you engage with the Service respectfully and in good faith. The following activities are not permitted:

• Copying, distributing, or republishing course materials without written permission.
• Using the Service for any unlawful purpose or to facilitate harm to others.
• Attempting to access systems or data beyond your authorised scope.
• Submitting content that is misleading, offensive, or infringes third-party rights.
• Misrepresenting your identity or qualifications when applying for a course.
• Using automated tools or scripts to access the Service without permission.

We encourage honest participation, steady effort, and respectful communication with mentors and fellow learners. Academic integrity is important to us.

Intellectual Property

All Content provided through the Service — including course materials, exercises, code samples, and mentor notes — remains the intellectual property of Witaya Lab or its licensors.

• Upon enrolment, you are granted a limited, personal, non-transferable licence to access and use the Content for your own learning.
• This licence does not permit redistribution, resale, or publication of the Content in any form.
• Work you produce during a course (projects, exercises, code) remains yours, though we may use anonymised examples for teaching purposes unless you object.
• The Witaya Lab name, logo, and design materials are protected trademarks and may not be used without permission.

Payment Terms

Course fees are as follows, in Thai Baht:

• Payment is due in full at the time of enrolment unless a payment plan has been agreed in writing.
• Prices are quoted in Thai Baht (THB) and may be subject to applicable taxes.
• Refund policy: You may request a full refund within 7 days of enrolment, provided you have not accessed more than the first module of course materials. After this period, fees are non-refundable except where required by law. If we cancel a course, a full refund will be offered.
• We do not store payment card details. Payments are processed through secure third-party providers.

Course-Specific Terms

In addition to the general terms above, the following apply specifically to courses:

• Enrolment confirms your understanding of the stated prerequisites for each course.
• Course access is personal and valid for the duration stated at enrolment. Extensions may be requested but are at our discretion.
• Completion of a course does not carry any external accreditation unless this is explicitly stated in the course description.
• Mentor feedback sessions are scheduled by mutual agreement and may require advance notice to arrange.
• We expect learners to approach coursework with academic honesty — submitting your own work and not misrepresenting others' contributions as your own.
• We reserve the right to remove a learner from a course, without refund, if conduct repeatedly disrupts the learning environment.

Disclaimers

The Service is provided on an "as is" and "as available" basis. While we take care in the quality of our materials and mentorship, we make no representations or warranties about:

• The accuracy, completeness, or timeliness of any Content.
• Specific outcomes or career progression following completion of a course.
• Uninterrupted or error-free access to the platform at all times.
• The suitability of the Service for any particular purpose beyond what is described.

Learning outcomes depend significantly on the effort, time, and prior experience of each individual. We aim to support your progress, but progress itself is in your hands.

Limitation of Liability

To the fullest extent permitted under Thai law:

• Our total liability to you arising from or related to these Terms shall not exceed the amount you paid us for the specific course giving rise to the claim.
• We are not liable for indirect, consequential, or incidental losses, including lost income or missed opportunities, even where such loss was foreseeable.
• We are not responsible for disruptions caused by factors outside our reasonable control — including power or internet outages, third-party platform failures, or unforeseen circumstances.

Indemnification

You agree to indemnify and hold harmless Witaya Lab, its team, mentors, and affiliates from any claims, damages, or costs (including legal fees) arising from your breach of these Terms, your misuse of the Service, or your infringement of any third-party rights. We will act reasonably in any situation before resorting to this provision.

Termination

• You may discontinue use of the Service at any time. Please refer to the refund policy in Section 7 for applicable conditions.
• We may suspend or end your access if you materially breach these Terms and fail to remedy the breach within a reasonable period after being notified.
• Sections relating to intellectual property, disclaimers, liability, indemnification, and dispute resolution survive termination.

Dispute Resolution

These Terms are governed by the laws of Thailand. If a disagreement arises, we ask that you first contact us directly so we can try to reach a fair resolution:

• Contact us at [email protected] with a clear description of the issue.
• We will acknowledge your message within 5 business days and work to resolve the matter informally within 30 days where possible.
• If informal resolution is not achieved, disputes shall be subject to the jurisdiction of the competent courts of Chiang Mai, Thailand.

Thai consumer protection law (including the Consumer Protection Act B.E. 2522 and relevant amendments) applies where relevant to your use of our Service.

General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the complete agreement between you and us regarding the Service.
• Severability: If any part of these Terms is found to be unenforceable, the remaining provisions continue in full effect.
• Waiver: Our failure to enforce any provision does not constitute a waiver of our right to enforce it later.
• Assignment: You may not assign your rights or obligations under these Terms to another party without our written consent.
• Notices: Formal notices to us should be sent by email to [email protected].

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page and, where the changes are significant, provide notice on our website or by email. Continued use of the Service after an update takes effect constitutes your acceptance of the revised Terms.
